The Document Reduction Act of 1980 (Pub L. No. 96-511, 94 Stat. 2812, codified at 44 USC Ã,§Ã,§Ã, 3501-3521) is a federal law The United States came into force in 1980 designed to reduce the total burden of documents federal government charges on private businesses and citizens. The law imposes procedural requirements on agencies seeking to collect information from the public. It also established the Office of Information and Regulatory Affairs (OIRA) within the Office of Management and Budget (OMB), and the authority of this new agency to oversee the collection of information from federal agencies from the public and to establish information policies. The substantial amendment, of the 1995 Document Reduction Act , confirms that OIRA authorities are extended not only agency orders to provide information to government, but also agency orders to provide information to the public.

Historical context

The preliminary legislation for the Document Reduction Act is the Federal Report Act of 1942. The law requires an agency to obtain the approval of the Budget Bureau (the direct predecessor of OMB) before forcing the collection of information imposed on the public. However, major departments such as the Internal Revenue Service (IRS) and Government Accountability Office (GAO) are exempt from the requirement, and the law is ignored including sanctions for noncompliance. In addition, OMB chronically lacks its responsibilities: in 1947, there were 47 personnel reviewing agency requests for the entire government, but by 1973 the number of reviewers had decreased to 25, and some of these reviewers had a number of additional responsibilities. The result of a lack of resources is weak supervision (only between 1 to 5 percent of applications denied) and longer delays. Some agents refuse to apply for approval; others seek and accept alternative processes, divide the regulatory system and increase the chance of duplicate and wasteful information requests.

Substantive requirements

The law imposes a number of procedural requirements to agencies wishing to apply reporting or record keeping requirements to the public. For example, agencies must specify specific objectives met by information gathering, develop plans for the use of information, and in some cases test collection methods through pilot programs. The Agency should ensure that the form includes certain items, for example: an explanation to the listener about the purpose of gathering information, estimating the burden of the document, and whether the response is voluntary. In many cases, further institutions are required to publish notices about the proposed requirements in the Federal Register and allow at least 60 days for public comments about requirements and requirements requirements.

The Document Reduction Act mandates that all federal government agencies receive OMB approval - in the form of "control numbers" - before announcing paper forms, websites, surveys or electronic submissions that will impose the burden of collecting information on the general public.. The term "load" is defined as something outside "that is necessary to identify the respondent, date, address of the respondent, and nature of the instrument." Nothing can be penalized for refusing an information collection request that does not display a valid control number. Once obtained, approval must be renewed every three years.
